1. APPLICABLE LEGISLATION
As of 14 June, the new regulations on distance selling entered into force pursuant to Legislative Decree No. 21/2014, implementing Directive 2011/83/EU on consumer rights, amending Directives 93/13/EEC (unfair terms in consumer contracts) and 1999/44/EC (sale of consumer goods), and repealing Directives 85/577/EEC and 97/7/EC (distance selling). These provisions update the Italian Consumer Code (Legislative Decree No. 206/2005), in particular replacing Articles 45 to 67 thereof. Any sales contract concluded between the Customer and Infonet s.r.l. unip. shall be governed by and interpreted in accordance with Italian law.
2. ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE
By placing an order in accordance with the procedures provided on the websites www.infonet-impianti.it and www.infonetportoni.eu, the Customer declares that they have read all the information provided during the purchase procedure and fully accept the Terms and Conditions of Sale set out below. These General Terms and Conditions of Sale form an integral part of the sales contract concluded between the Customer and Infonet s.r.l. unip. Customers are therefore invited to read these General Terms and Conditions of Sale carefully and to print or otherwise retain a copy.
3. GENERAL PROVISIONS
These General Terms and Conditions of Sale govern the contractual relationship arising from the acceptance by Infonet s.r.l. unip., with registered office at Via Terramassi 31, 37044 Cologna Veneta (VR), Italy, VAT No. 02876620234, of the Customer’s purchase order. Infonet s.r.l. unip. reserves the right to amend or update these General Terms and Conditions of Sale at any time at its sole discretion. The most up-to-date version shall always be published on the websites www.infonet-impianti.it and www.infonetportoni.eu. Customers are required to check the applicable version in force at the time of placing their order. These General Terms and Conditions of Sale do not apply to exports of products outside the territory of the European Union, which are subject to different contractual conditions. Should the Customer export products supplied in Italy, the Customer shall be solely responsible for obtaining, at their own expense, all necessary licences and authorisations and for complying with export regulations between Italy and the destination country.
4. PURCHASE PROCEDURE
Customers may purchase products through the websites www.infonet-impianti.it and www.infonetportoni.eu by selecting the desired items from the Online Shop menu and clicking “Go to cart”.
Infonet s.r.l. unip. does not offer made-to-order purchases; however, if an item is temporarily unavailable, the Customer may send an email to infonetportoni@gmail.com to request availability information. Any timelines provided are indicative and not attributable to Infonet s.r.l. unip.
Customers will be informed by email of the status of their order.
5. PRICES
Prices displayed on the websites include VAT at the rate applicable on the invoice date and include packaging costs. Prices may be subject to change. For further information, Customers may contact Customer Service via the “Contact Us” section or by emailing infonetportoni@gmail.com.
6. DELIVERY
Shipping costs are indicated in the order details and include VAT. Costs vary according to weight. Any changes to shipping costs will always be visible during the shipping selection process. Deliveries are carried out by Mail Boxes Etc. Italia to the address provided by the Customer. Infonet s.r.l. unip. will notify the Customer by email when the product is shipped, providing the MBE tracking code.
Customers may request a free additional service (e.g. delivery with telephone notice) during checkout by specifying it in the notes section. Correct entry of address, telephone number and email details is essential.
7. WARRANTY
Infonet s.r.l. unip. provides the following warranty terms:
– Sales to private individuals: 24 months in accordance with national legislation, applicable to accessories only. Products subject to programmed wear, such as custom-assembled springs, are excluded from any time-based warranty.
– Sales to VAT-registered businesses: 12 months on accessories only. Products subject to programmed wear are excluded from warranty.
All products sold to private consumers are covered by the statutory 24-month legal warranty of conformity pursuant to Legislative Decree 206/2005. The warranty applies solely to conformity defects existing at the time of delivery and does not cover damage caused by improper use, incorrect installation or tampering.
The warranty is excluded, particularly for electrical and electronic spare parts, in cases including but not limited to: installation on defective or untested equipment, use on faulty or improperly diagnosed devices, electrical surges, polarity reversal, incorrect power supply or wiring, visible signs of burning or tampering, or use in environments not compliant with technical specifications.
Maintenance and installation of garage doors and automation systems must be carried out exclusively by qualified personnel. Failure to comply results in forfeiture of the warranty.
Warranty for Used Products
Used products benefit from the statutory warranty of conformity pursuant to Articles 128 et seq. of Legislative Decree 206/2005. The used condition is always clearly stated. Given the nature of used goods, the warranty duration is limited to 12 months from delivery, pursuant to Article 134(2) of the Consumer Code. Used products may show aesthetic imperfections that do not affect functionality and do not constitute defects of conformity.
The warranty covers only functional conformity defects existing at delivery and reported within two months of discovery. Remedies include repair, replacement, price reduction or contract termination in accordance with Articles 130 et seq. of the Consumer Code.
To request warranty service, the Customer must provide written notice including order number, purchase date, detailed defect description, photographs where available, and technical information on the installation system. Requests lacking sufficient technical detail may be rejected.
8. INSPECTION OF PRODUCTS
Customers must inspect products upon delivery and report any defects within 14 days. Failure to do so constitutes acceptance. Hidden defects may be reported within one year of delivery for non-custom products, provided notice is given within 14 days of discovery. Damaged packages must be refused at delivery and immediately reported to Infonet s.r.l. unip.
9. RIGHT OF WITHDRAWAL
No returns or refunds are permitted for custom-made products (e.g. springs assembled to size, steel lifting cables, seals). Other products may be returned only with prior authorisation from Infonet s.r.l. unip. Requests must be submitted by email. Returned products must be unused, intact and in original packaging, and returns must be initiated within 14 days of the invoice date. Return shipping costs are borne by the Customer unless otherwise agreed.
10. REFUNDS
Infonet s.r.l. unip. shall issue the refund using the same payment method used by the Customer for the original transaction, unless otherwise agreed between the parties, once the returned goods have been received and their integrity has been verified.
In the event of exercise of the right of withdrawal, the refund shall include the price of the returned products and the cost of the least expensive standard delivery option available at the time the order was placed.
If the Customer has expressly chosen a delivery method more expensive than the standard delivery (for example, express shipping), the additional cost shall not be refunded, in accordance with applicable European legislation.
The costs for returning the goods shall be borne by the Customer, unless otherwise specified.
11. PRODUCT INFORMATION AND AVAILABILITY
Product usage and safety information is provided in the manuals. Dimensions are subject to normal commercial tolerances. Infonet s.r.l. unip. reserves the right to modify or discontinue products at any time without notice.
12. LIMITATION OF LIABILITY
Once goods are handed over to the courier, liability for damage during delivery lies exclusively with the carrier. Infonet s.r.l. unip. shall not be liable for indirect damages, loss of profit, or improper installation or use. Installation must comply with applicable CE standards and be performed by qualified technicians only.
13. PAYMENTS AND EXPRESS TERMINATION CLAUSE
Payments may be made by bank transfer, PayPal/credit card, or cash on delivery. Failure to pay within 15 days results in automatic termination pursuant to Article 1456 of the Italian Civil Code, with late payment interest applied as provided by law.
14. CURRENCY
All payments shall be made in Euro.
15. ORDER CANCELLATION
Orders may be cancelled or rejected by Infonet s.r.l. unip. within 48 hours. Any payments received will be refunded in full. Orders unpaid after 15 days are considered cancelled.
16. FORCE MAJEURE
Infonet s.r.l. unip. shall not be liable for delays or non-performance due to force majeure or unforeseeable events. Customers may cancel the order within three days of notice of delay.
17. PERSONAL DATA PROCESSING
Personal data is processed in accordance with applicable law and as detailed in the Privacy Policy available at www.infonetportoni.eu under the Privacy & Cookies section.
